Terms of Service for Recaster Services

Preamble

These Terms of Service (hereinafter "Terms") govern the relationship between Recaster Software GmbH, Eduard-Schloemann-Str. 35, 40237 Düsseldorf, Germany (hereinafter "Recaster," "we," "us") and you (hereinafter "User," "you") for the use of all online services and platforms offered by Recaster (collectively, the "Recaster Services"). Access to Recaster Services is managed through a central user account ("Recaster Account") via Single Sign-On (SSO). These Terms become part of the contract upon creation of a Recaster Account.

§ 1 Scope and Contract Formation

1. Scope: These Terms apply to use of the Recaster Services accessible via a Recaster Account, whether free or paid.
2. Contract Formation: The user agreement is concluded upon successful registration and account activation. By submitting registration, you make a binding offer and accept these Terms.
3. Eligibility: You must be at least 18 years old. Minors aged 16+ may use services only with explicit guardian consent.

§ 2 Scope of Services and Availability

1. Free Services: For free services, there is no entitlement to a specific scope or uninterrupted availability. Recaster may modify, restrict, or discontinue free services at any time.
2. Continuous Development: We may adapt features and design where required for technical progress, legal obligations, or operational quality.
3. Availability: We strive for high availability but cannot guarantee uninterrupted operation at all times (e.g., maintenance, updates, force majeure, network disruptions).

§ 3 User Obligations and Fair Use Policy

1. Account Security: Keep credentials confidential and protected from unauthorized access.
2. Truthful Information: Registration data must be complete, accurate, and kept up to date.
3. Lawful Use: Services may not be used for illegal purposes.
4. Fair Use: Prohibited activities include abusive API use, scraping, account enumeration, flooding, security bypass attempts, brute-force attacks, hacking attempts, and reverse engineering. Violations may result in suspension or termination.

§ 4 User-Generated Content

1. Intellectual Property: You retain ownership of your created content.
2. Grant of Rights: You grant Recaster a worldwide, royalty-free license to store, reproduce, and where made public by you, display such content for service operation.
3. Responsibility: You are responsible for your content and must not publish illegal, extremist, racist, offensive, pornographic, or otherwise unlawful content.

§ 5 Term and Termination

1. Term: The user agreement is concluded for an indefinite period.
2. User Termination: You may delete your Recaster Account at any time, subject to active paid subscriptions.
3. Recaster Termination: Free accounts may be terminated at any time. Extraordinary termination for cause remains unaffected.

§ 6 Liability, Data Protection, and Final Provisions

1. Liability: Liability follows statutory provisions; for free services liability may be limited to intent and gross negligence.
2. Data Protection: Details on personal data processing are set out in our Privacy Policy.
3. Final Provisions: German law applies. Invalid provisions do not affect validity of remaining provisions. Users are informed of material changes to these Terms in advance.

Governing Language

The German version of these Terms is the sole legally binding version. Other language versions are informational and non-binding in case of discrepancies.
